In what cases will there be a refund for kindergarten?
The possibility of returning money for kindergarten fees is provided for by the legislation of the Russian Federation. In Article 52.2 of the Law “On Education”, parents of preschool children attending kindergarten have the right to return part of the money they paid for the services of an educational institution.
The Federal Law states that any family has the right to compensation for kindergarten fees. This law is in effect to provide financial support for the upbringing and education of children in preschool educational organizations - in other words, the law encourages children to attend such institutions and encourages parents to work.
However, the constituent entities of the Russian Federation have the right to regulate the work of this law by issuing their own legal acts or laws that will establish criteria of need. Thus, each region of the country, depending on the direction of its development and the size of the budget, can decide which categories of citizens to pay compensation (for example, based on the size of their income).
Who is eligible for a refund?
Any parent (or guardian) who has entered into an agreement with the kindergarten and carries out payment for his visit child In addition, as already mentioned, entities can establish additional payment conditions based on the amount of income of the parents, the number of children in the family, the average income in the region, etc.
In addition, the amount of compensation for kindergarten fees for parents belonging to certain preferential categories is established by law. Citizens of these categories can count on compensation in the amount of 50% of the amount that must be paid for visiting the kindergarten. This compensation is considered a separate benefit and affects not only the amount of money returned, but also the order in which children are admitted to kindergarten.
Since 2016, 13% tax (personal income tax) will no longer be withheld from compensation paid. This is a small amount relative to the interest paid, but this fact may be relevant for parents who receive compensation for several children attending kindergarten at once.
Documents for a refund for kindergarten
Let us remind you that the state can return money only to the parent in whose name the contract with the kindergarten was concluded. To apply for compensation, you must collect a package of documents, which includes:
- a statement, a sample of which can be determined by each preschool educational institution individually (its form is not approved by law);
- a copy of the parent’s passport (in the case of a guardian, documents confirming guardianship must also be attached);
- data on the applicant’s marital status: certificate of family composition and copies of birth certificates of children attending kindergarten;
- information about the bank account to which compensation will be credited.
In some regions, it is additionally required to provide a certificate of stay in line at the preschool educational institution, an order maternity leave and other papers. The full list of documents must be clarified in the specific preschool educational institution with which the parents have an agreement, or in the social authorities. protection if the parents' application for compensation is refused by the district office.
The package of documents must be given to the head of the kindergarten, and the date of receipt of the documents is recorded in a special journal. The safety of each document is the responsibility of the DOU.
Since 2019, after certification of all documents, the administration of the preschool educational institution can redirect the parent to submit documents to local government authorities or social services. protection. The specific institution dealing with such payments should be clarified in regional legislation.
How to correctly calculate the amount of compensation
Calculation
The amount of compensation depends on the number of children in the family, and a partial refund is calculated from the amount of parental fees for the maintenance of the child as a whole - for food, a place in kindergarten, additional educational services (if any), etc.The percentage of compensation depends on the total number of children in the family, regardless of how many of them attend kindergarten. The compensation percentages are as follows:
- first child – 20%;
- second child – 50%;
- third and subsequent children – 70%.
In addition to the number of children in the family, in size compensation plays a role in the average parental payment of a preschool educational institution of this category for a particular region. This is especially true for private kindergartens, where payment compensation occurs precisely in relation to this value, and not the fee established by the contract.
Please note that the amount of parental payment does not necessarily have to be the monthly fee set by the kindergarten. The interest deduction is based on the actual amount spent by the parent. For example, if out of 23 working days of the month a child attends only 20, then the actual payment decreases according to the days missed - which means the compensation also becomes less.
Important! Although Regions have the right to set the amount and limitations of compensation paid, in accordance with federal law its size cannot be less than 20% of the average parental payment for a preschool educational institution of this category in a particular region.
How does a refund for kindergarten work?
The decision to pay compensation is made not by the kindergarten administration, but higher authorities. The procedure for obtaining compensation may be different in each region of the country, depending on the formed legislative acts on this issue. Documents submitted to the kindergarten manager undergo the following processing algorithm before becoming the basis for payment of compensation:
- copies of all submitted documents are verified with the originals and certified by the seal of the preschool educational institution, after which the originals are returned to the applicant;
- information from the submitted documents forms the basis for the generated lists, which the administration of the preschool educational institution transmits every quarter to the authorities of the district administration, social protection and education.
If the district administration refuses to accept the application, the applicant contacts the social authorities. protection with the same package of documents, attaching to it an agreement with the preschool educational institution and copies of receipts for payment for educational services.
The payment is made by the preschool educational institution itself through the accounting department. However, you will have to confirm your right to receive compensation every quarter - i.e. constantly provide the specified package of documents to the head of the preschool educational institution. Parents may have difficulties in returning part of the money for a private kindergarten. The law states that financial support is provided only to visitors of state and municipal educational institutions.
However, the right to compensation is still granted to clients of private gardens. True, its calculation is not based on the actual payment established by the contract, but on the average cost of a preschool educational institution of this category in the region. For example, if a private kindergarten is classified in the second category, then the parental payment for compensation will be calculated relative to the average cost of visiting a state preschool educational institution of the second category, and not for the entire month, but by the number of days that the pupil visited.
In private preschool educational institutions, the contract provides for a refund for days when the child is absent from the group - for example, a refund for meals or for a place. However, the regulation of this issue is entirely under the responsibility of the administration of the institution, which sets such standards independently. All payment details are specified in the agreement concluded with the institution.
Thus, compensation for kindergarten attendance can provide significant financial assistance to parents with several children attending kindergarten. The procedure for processing such compensation itself does not require collecting a large amount of paperwork, but its conditions largely depend on regional laws.

Compensation for kindergarten- state reimbursement of part of the parental money spent on paying for the child’s stay in kindergarten. The size of the payment depended only on which child in the family began to attend kindergarten:

- if the second – 50%;
- if the third (or subsequent children) – 70%.
These rules are still in effect today, but they have an important clarification:

The right to compensation for kindergarten expenses, as well as complete exemption from this fee, is established by the Law on Education in the Russian Federation No. 263-FZ (Article 65). The same regulatory act establishes another rule: regions must determine the maximum cost of preschool educational institutions for the supervision and care of young pupils, which cannot be exceeded. Judging by the statistics of average consumer prices for these services for the first three months of 2018, Russian entities set them in a huge range:
- St. Petersburg – 29.61 rubles/day;
- Chechen Republic – 75.80 rubles/day;
- Pskov region – 88.83 rubles/day;
- Moscow – 142.11 rubles/day;
- Saratov region – 152.44 rubles/day;
- Kamchatka Territory – 201.14 rubles/day;
- Magadan region – 224.30 rubles/day.
Compensation from the Russian Ministry of Defense
Additional compensation for kindergarten was provided by the Ministry of Defense of the Russian Federation. They are intended for certain categories of parents whose daughters and sons attend preschool institutions of the military department. Preferences for payment for kindergartens are established by Order of the Minister of Defense of Russia dated November 24, 2014 No. 862 (Appendix 2).
Recipients of compensation in the amount of 50%, regardless of the number of children in the family, are::
- conscripts;
- Chernobyl liquidators;
- disabled people assigned to group I or II;
- employees of subordinate kindergartens.
Parents (trustees, guardians) of three or more children receive the same compensation if one of their children attends a “military” kindergarten. Legal representatives of a child with low incomes who have the status of low-income citizens (confirmed by a certificate from social security) are completely exempt from fees.
Payment processing procedure
Compensation for kindergarten is not calculated automatically, but is of a declarative nature. That is, the parent must indicate that he wishes to receive this payment. To do this, he writes an application addressed to the head of the kindergarten, in which he asks to compensate his expenses for the services of the preschool educational institution.
The paper is submitted to the accounting department of the preschool educational institution. If its employees refuse to accept an application for compensation, you should contact the social security authorities (compensation department).
What is indicated in the application
An application for monetary compensation must contain several mandatory items:
- to whom it is addressed - full name of the head of the kindergarten with the name of the institution she heads;
- by whom the paper was drawn up - full name of the parent/guardian of the pupil, indicating the address of his residence;
- a request for partial compensation of kindergarten costs for the 1st, 2nd or subsequent child (it is important to indicate which one, since the amount of compensation depends on this);
- Full name of daughter or son attending kindergarten;
- name of the preschool educational institution;
- passport details of the applicant parent;
- list of documents to be transferred;
- date of writing and signature.
When submitting an application, the parent should ensure that it is properly registered. It is better to make it in duplicate and ask to also put the date and incoming number on the second (own) copy. Only such a document will confirm the fact that the mother or father has applied for compensation in any instance, including the court.

The right to compensation and the identity of the applicant are confirmed by the following documents:
- a photocopy of the Russian passport of the parent or guardian;
- a copy of the registry office certificate of the birth of the child (if he is not the only one in the family, you must attach copies of certificates for all children);
If in order to receive a payment you must have a family income no more than a certain level, the applicant will have to document that it has not been exceeded. To do this, you will need certificates about the salaries of family members, the amount of pensions and benefits, the amount of alimony, and other similar documents. How and when is paid

The submitted application along with the attached documents are first checked in the kindergarten by the employee who accepts them. He needs to check them with the originals, so applicants need to carry them with them. It is also subject to verification whether a complete set of papers was provided by the parent or guardian, and whether they really indicate the citizen’s right to compensation.
Then, the preschool educational institution’s accounting department employees independently submit the application and documents to the social security authorities and the education department. There they are checked again, after which a decision is made either to pay compensation or to refuse it. In the latter case, the applicant must be notified in writing of the reasons for not providing monetary payment for the garden.
If the decision is positive, parents will receive the first compensation for their child’s stay in a preschool institution the following month. It goes to the bank or “card” account specified when submitting documents.
Attention! Parents do not lose the right to compensation if the child attends a private kindergarten. It is paid in the same amounts and in the same manner as compensation amounts for a regular (state) kindergarten. There is only one restriction regarding a preschool educational institution: it must have a license.Not the entire amount paid for a commercial kindergarten will be compensated. Sometimes it can reach tens of thousands of rubles, and the state is not ready for such compensation. As a rule, they are not required by citizens who are able to pay such significant sums for a child’s preschool education. Compensation is calculated based on the average cost of such services in public kindergartens in the region.
Compensation for lack of a place in kindergarten
The Law on Education (Article 5) guarantees its universal accessibility at any level. Including preschool. But, despite the fact that many parents have to wait in line for years for kindergarten, the federal government has not taken responsibility for failing to fulfill its own promises. Unified all-Russian compensation for failure to provide a place in kindergarten has not yet been provided, although a bill on such payments has been wandering around the central government for many years. They could become a real support for families where one of the parents (and sometimes the only parent) cannot start working because they have nowhere to leave the baby during this time.
Today, the decision on compensation for parents who were unable to place their child in a preschool institution is made at the local level. And not all regions responded to this proposal, understanding how significant budget expenditures under this item could be. In particular, such compensation is not provided even by such a rich metropolis as Moscow.
But in many regions, parents actually receive some payments for not having a place in kindergarten. Their amounts are small and, as a rule, vary from 1.5 to 5 thousand rubles. Although, for example, in Yaroslavl the amount of compensation in 2017 until the child’s 3rd birthday is only 591 rubles.
The age of the child is also established, during which regional authorities are willing to pay something. In some regions it begins at one and a half years and expires when the “home child” reaches three years of age (Kirov, Krasnoyarsk, Samara). In others, on the contrary, compensation begins to be paid only when the child turns 3 years old (Lipetsk).
The main documents that need to be presented to social security officials or the education department:
- referral for registration of a child in a preschool institution;
- a written refusal of a kindergarten to admit a child due to lack of space in a preschool educational institution.
Regional compensation for kindergarten
Each region sets the amount of compensation payments and the conditions for receiving them in accordance with budgetary possibilities. Therefore, accurate information on this issue must be obtained from local social protection authorities.
For example, legislators in St. Petersburg did not limit themselves to the minimum requirements of the law on education and established additional compensation for parents:
- 40% of the payment - if the child is raised by a single parent in a low-income family (less than 2 subsistence minimums for each family member);
- 50% of the payment – if one of the parents has a disability (1st or 2nd group);
- 70% of the payment - if the average per capita income in the family does not reach the subsistence level.
And in cities such as Tolyatti and Samara, compensation for kindergarten is paid only to those families whose members have an income of less than 1.5 times the subsistence level (for each).
