The amendments to the Ministry of Finance, signed on May 5 by the president within the framework of 112-FZ, edited the law “On the Protection of Consumer Rights” and Article 14.8 of the Code of Administrative Offences, Anton Siluanov’s department said. From this month, trading enterprises with revenue over 60 million rubles a year are required to accept bank cards for payment. Stores whose turnover does not reach this level will, if the amendments in the current version are adopted, be able to continue to charge payments only in cash. Fines will begin on January 1, 2015, until then there will be a transition period so that enterprises can prepare for the new legislative norms.
Considering the widespread use of payment cards among the population, these changes will ensure equal rights for consumers in terms of the means of payment used, both in cash and non-cash form, the press service of the Ministry of Finance explained to Izvestia. - This will have a positive impact on the development of non-cash forms of payment and the availability of payment infrastructure, will increase the transparency of the turnover of trade and service organizations, and will also contribute to strengthening the fight against tax evasion, fees and the laundering of proceeds from crime.
According to the new part 4 of Art. 14.8 of the Code of Administrative Offenses of the Russian Federation, refusal to accept cards for payment entails the imposition of an administrative fine on legal entities - from 30 thousand to 50 thousand rubles. If the store has the technical ability to accept cards, but the seller still refuses, then a fine may be imposed on him as an official - from 15 thousand to 30 thousand rubles.
This is being done to stimulate non-cash turnover, says State Duma deputy, one of the authors of the adopted idea, Anatoly Aksakov. - Card reader must be installed in the vast majority of retail outlets, with the exception of companies with revenue below 60 million rubles per year.
The banks will win
Small trade enterprises - for example, stalls with vegetables, cigarettes and drinks, market traders, convenience stores, and so on - will not be subject to universal rationing. For them, installing card readers is associated with significant expenses (a card reader costs about 6–18 thousand rubles). Banks install such terminals for free, but to ensure non-cash payments they need the Internet, which small merchants do not have in principle. The burden of the costs of the transactions themselves also falls on the merchants.
For transactions for accepting payments by banks, a commission from 1% to 3–5% is withheld from a trading organization, says Mikhail Gerasimov, a member of the presidium of the Association of Young Entrepreneurs of Russia. - Therefore, it is always more profitable for a trading company to receive cash and not pay interest on a non-cash card payment from a buyer.
In fact, it is often more convenient for consumers themselves to pay for small purchases in cash. It's a different matter when it comes to large purchases - for example, a car. Previously, it was even planned to establish equivalent severe fines for the lack of card readers - for the amount of the purchase.
If the seller accepts a payment of 1 million rubles in cash, he will be fined 1 million rubles, Deputy Minister of Finance Alexey Moiseev told Izvestia. However, later the department decided to establish a clear framework, limiting the size of sanctions in such a way as not to lead to massive bankruptcy of trade enterprises, and a new range of fines is now fixed in the Code of Administrative Offences.
Bankers reacted positively to the innovation.
This initiative does not have anything bad in it, says Denis Davydov, director of the retail business department of SDM Bank. - On the contrary, it is customer-oriented and aimed at increasing convenience for end customers. The banking community perceives it quite positively. Non-cash transactions streamline the market, make it understandable and transparent.
According to Davydov, the possibility of non-cash payment allows clients to save time, avoid paying commissions for withdrawing money from an ATM if there is no terminal from the card-issuing bank at hand, and use credit cards.
The initiative of the state, which decided to forcibly limit cash payments, has its own logic, says Mikhail Yatsenko, vice president of MTS Bank. - There is a large market for gray capital in Russia, and stores have ways to understate revenue. At a minimum, this is money that is simply hidden from taxes. The new norms, of course, will not solve the problem, but they will undoubtedly have a significant impact.
The innovation is primarily beneficial to banks, because the size of their commission within the framework of a trade payment reaches 1.5% of the transaction amount (it is paid by the acquiring bank with which the store works, to the bank issuing the card; the merchant, as a rule, pays the acquirer 1. 6%). Payment systems are also nicer - they receive a commission of 0.1% on each transaction. The innovation stimulates the growth of acquiring volumes and the turnover of card payments.
Russians will pay for their unconscious movement towards “plastic”
The press services of Rospotrebnadzor, the Central Bank and the Ministry of Economic Development were unable to provide comments. It is not difficult to guess to whom the stores will shift their new costs.

Retailers are showing restrained pessimism.
Retail chains understand the importance and convenience for consumers of using bank cards, comments Andrey Karpov, executive director of the Association of Retail Trade Companies. - Currently, almost all retail chains provide the buyer with the opportunity to pay for purchases using a card. The proposal to fine only retail outlets indicates a lack of understanding by its initiators of the mechanism for ensuring non-cash payments. The trading facility only creates the opportunity to make a payment by installing the appropriate payment terminals, but the acquiring itself is carried out by banks. The trading entity should not be responsible for problems that arise with the acquirer in other cases.
Experts point out one nuance - citizens cannot be aware of the turnover of a particular retail outlet, and therefore it cannot be ruled out that Rospotrebnadzor, after the amendments come into force, risks being overwhelmed by mass appeals from Russians. Many may have their own scores with one or another store. According to Izvestia’s interlocutors, it would be more correct if retail outlets were inspected by representatives of Rospotrebnadzor themselves, including as “mystery shoppers.” It is also impossible not to take into account the low level of card culture among Russians - mostly citizens use a bank card to withdraw cash on payday.
Yuri Fedorov, partner at the law bureau Olevinsky, Buyukyan and Partners, suggests that it was no coincidence that the stimulation of non-cash turnover was required during the period of vigorous cleanup of the banking sector, which is being carried out by the Bank of Russia. And under such circumstances, it is intended to become a measure that partially compensates banks for the loss of customer confidence in them.
The proposal to limit the use of payment cards at retail outlets with revenues of less than 60 million rubles indicates that the authors of the amendments were not particularly concerned about the interests of real consumers, says Fedorov. - And, perhaps, in the future, when going to buy bread, the consumer will have to decide in advance whether to buy it in a hypermarket or in a bakery across the road, whether he has cash with him or only funds on his card.
